1. Acceptance of Terms

By accessing or using Roast Cards ("the App"), operated by Brainvita Pty Ltd ("we", "us", "our"), ABN [Your ABN], you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

Roast Cards is an entertainment application that generates pre-made roast cards featuring fictional cartoon characters and pre-approved, kid-safe text lines. The App offers:

1 free roast card generation
Additional roast packs available for purchase (e.g., 20 roasts for $1 AUD)

3. Eligibility

The App is available to users of all ages. All content is designed to be family-friendly and kid-safe. No account creation is required.

4. Purchases & Payments

In-app purchases are processed securely through Stripe, a PCI DSS Level 1 certified payment processor. We do not store, access, or process your credit card details directly. All payment information is handled entirely by Stripe.

All prices are in Australian Dollars (AUD) unless stated otherwise
All purchases are one-time payments, not subscriptions
Purchased roast credits are stored locally on your device
Credits are non-transferable between devices

5. Refund Policy

Due to the digital nature of the product and immediate delivery, refunds are generally not available. However, if you experience a technical issue preventing you from using purchased credits, please contact us at support@brainvita.com.au and we will resolve the issue or issue a refund at our discretion.

6. Intellectual Property

All content in the App, including but not limited to character designs, roast text, code, and visual assets, is owned by Brainvita Pty Ltd or used under licence.

You may download and share generated roast cards for personal, non-commercial use. You may not:

Sell or commercially distribute roast cards
Claim ownership of the characters or content
Use the App's content to harass, bully, or target real people
Reverse-engineer, copy, or redistribute the App's source code

7. Acceptable Use

Roast Cards is designed for light-hearted entertainment. You agree not to use the App or its generated content to:

Bully, harass, or target any real person
Create content that is hateful, discriminatory, or harmful
Violate any applicable laws or regulations

8. Content Safety

All content in the App is pre-approved and kid-safe. There is no user-generated content, no user uploads, and no AI-generated content at runtime. All images are fictional cartoon characters. All text is reviewed and approved before inclusion.

9. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection legislation.

10. Limitation of Liability

To the maximum extent permitted by law, Brainvita Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App constitutes acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
